Terms of Service

1. Acceptance of terms

By accessing or using Falfesh.com, ProjectHub, or any other service operated by Falfesh ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, do not use our Services.

2. The service

Falfesh provides a suite of online tools including the ProjectHub project management platform. We reserve the right to modify, suspend, or discontinue any part of the Services at any time. We will provide at least 30 days' notice before shutting down a paid service, except where immediate action is required for security or legal reasons.

3. Accounts and organisations

ProjectHub operates on a multi-tenant basis. Each organisation ("Tenant") gets its own isolated workspace. The first administrator of a Tenant ("Tenant Admin") is responsible for managing access, users, and permissions within that workspace.

You are responsible for:

• Keeping your password secure and not sharing it
• All activity that occurs under your account
• Ensuring your team members comply with these Terms
• Notifying us immediately at admin@falfesh.com if you suspect unauthorised access

4. Subscription plans and payment

ProjectHub is available on the following plans:

Subscriptions are billed monthly. Prices are quoted in USD and are exclusive of applicable taxes. We may adjust pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

Refunds are considered on a case-by-case basis. Contact admin@falfesh.com within 7 days of a charge to request a refund.

5. Suspension and termination

We may suspend or terminate your access if:

• Your subscription payment is overdue
• You violate these Terms
• Your account is involved in abusive, illegal, or harmful activity
• We receive a valid legal order requiring us to do so

When a Tenant is suspended for non-payment, users can still log in but all write actions are disabled until the subscription is renewed. A clear notice is shown at all times during suspension.

When an account is terminated, we will retain your data for 30 days to allow you to export it, after which it is permanently deleted.

6. Your data

You own all data you input into the Services ("Customer Data"). We do not claim any intellectual property rights over your Customer Data. We process it only to operate and improve the Services as described in our Privacy Policy.

You may export your Customer Data at any time. You are responsible for ensuring you have the right to upload any content you put into the Services.

7. Acceptable use

You agree not to use the Services to:

• Violate any applicable law or regulation
• Upload malicious code, spam, or unsolicited communications
• Attempt to gain unauthorised access to any account or system
• Interfere with or disrupt the integrity or performance of the Services
• Harvest or scrape data from the Services in bulk without permission
• Impersonate another person or organisation

Violation of these rules may result in immediate termination of your access without refund.

8. Intellectual property

The Services, including the software, design, text, and graphics, are owned by Falfesh and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand name.

We grant you a limited, non-exclusive, non-transferable licence to access and use the Services for your internal business purposes.

9. Availability and uptime

We aim for high availability but do not guarantee uninterrupted access. Planned maintenance will be announced in advance where possible. Unplanned outages will be communicated via our status page as quickly as possible.

We are not liable for losses arising from service unavailability.

10. Disclaimers and limitation of liability

The Services are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Falfesh's total liability for any claim arising under or related to these Terms shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Falfesh is registered. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration if negotiation fails.

12. Changes to these terms

We may update these Terms from time to time. We will notify all active users by email at least 14 days before any material change takes effect. If you do not agree to the updated Terms, you must stop using the Services before the change takes effect.
